TPPF statement on Texas lawmakers’ amicus brief in plastic bag ban case

The Texas Public Policy Foundation’s (TPPF) Center for Local Governance Director James Quintero issued the following statement on the amicus curiae brief filed earlier this week by three Texas State Senators and 17 Texas State Representatives in support of the Laredo Merchants Association’s legal challenge to the City of Laredo’s plastic bag ban. The Brief, filed in the 4th Court of Appeals, argues that current state law “preempts and invalidates” this type of plastic bag prohibition.

Media availability at client property in short-term rental ordinance lawsuit

The Texas Public Policy Foundation (TPPF) will hold a media availability at the property of Ahmed Zaatari, a plaintiff in Zaatari et. al v. City of Austin, et al. The Texas Public Policy Foundation filed a lawsuit Friday to halt the City of Austin’s short-term rental (STR) ordinance restricting property owners and guests. TPPF’s Center for the American Future, aided by the Center for Local Governance, represents individual property owners and entrepreneurs in the lawsuit, Zaatari et. al v. City of Austin, et al., which seeks declaratory and injunctive relief from the unconstitutional city ordinance.

TPPF releases paper on mandatory sentencing enhancements in Texas

 The Texas Public Policy Foundation today released a paper by Center for Effective Justice Deputy Director Derek Cohen examining sentencing enhancements in Texas. The paper, Texas’ Mandatory Sentencing Enhancements, examines the effectiveness of statutory provisions that raise the minimum threshold of criminal sentence based on a certain characteristic of the offense or offender, and provides policy recommendations for how best to deal with current and potential future enhancements.
