AUSTIN, TX – Texas Public Policy Foundation’s Center for Local Governance Director James Quintero issued the following statement on Texas Attorney General Ken Paxton’s announced intervention into a property tax lawsuit, stating that local school districts violated the Texas Constitution and state law when they reduced or repealed their Local Option Homestead Exemptions (LOHE).
“Local government entities, including school districts, must respect the rule of law,” said James Quintero. “Local governments do not have the luxury of deciding which laws to follow and which to ignore. Yet on a whole host of issues, this radical perspective appears to be on the rise, on issues as wide-ranging as plastic bag bans to sanctuary cities to Extra-Territorial Jurisdiction regulations. It’s important that state officials take a leading role in correcting this unlawful behavior.”
