The Texas Public Policy Foundation’s (TPPF) Armstrong Center for Energy and the Environment Policy Analyst Leigh Thompson testified today before the Texas House Natural Resources Committee on House Bill 4112, relating to the rights of an owner of groundwater.

“Fortifying the private property rights of landowners in their groundwater in place is a great policy and great addition to statutory law,” said Thompson “House Bill 4112 takes a step in that direction. However, this bill needs to go further by codifying the specific language of Edwards Aquifer Authority v. Day. Clear statutory language provides much needed guidance to local Groundwater Conservation Districts and avoids a moving goal post in respect to common law which is subject to change.”
