AUSTIN – The Supreme Court of Texas is set to hear oral arguments on city governments regulating people and property outside their borders under “extraterritorial jurisdiction” (ETJ). The Texas Public Policy Foundation is representing the plaintiffs in the case against the City of College Station.

ETJs fundamentally violate a citizen’s constitutional guarantee to a republican form of government by trapping residents under a city council they did not and cannot vote for. In the absence of electoral consequence, government officials have no real incentive to take ETJ residents’ concerns into account when formulating policy and enforcing restrictions.
