NEW ORLEANS – The U.S. Court of Appeals for the Fifth Circuit is set to hear arguments in a case challenging the City of New Braunfels’ unconstitutional ban on short-term rentals (i.e., homes rented for less than thirty days). Texas Public Policy Foundation (TPPF) attorneys representing the plaintiff filed their opening brief in March.

The case centers on the City of New Braunfels’ decision to prohibit new short-term rentals, while allowing hundreds of pre-existing rentals to operate and while allowing high impact commercial uses—like the largest water park in the country—to operate in the same neighborhoods. The case turns on whether facts matter at all when the City decides to eliminate a traditional property right, or whether majority preference alone can justify a zoning ordinance.
