The Texas Public Policy Foundation has won its open records lawsuit against the City of Georgetown in response to the city withholding a “payback analysis” document from its client, Terry Putnam.

“TPPF’s client Mr. Putnam has been vindicated by the court’s ruling that the ‘payback analysis’ document is public and should not have been withheld by the City of Georgetown,” said Robert Henneke, general counsel at the Texas Public Policy Foundation. “The law presumes the right of the public to government records, and all Mr. Putnam wanted to know was the return on investment from one of the City’s solar panel projects. The court’s order is not only a win for Mr. Putnam, but a win for transparency in government that benefits all Texans.”

The court determined that the payback analysis, which was requested by Mr. Putnam in Nov. 2016, is not exempt from public disclosure and must be disclosed.
