The Texas Public Policy Foundation Presents
Plumbing the Depths of Surface Water Rights
For the past three years, most of Texas has been experiencing a drought. Lakes are fractions of what they once were while the country side and our communities are crisscrossed by dry creek beds.
The severe drought required use of TCEQ’s emergency authority to curtail some water rights, an action now challenged in Texas courts. The Fifth Circuit Court of Appeals is now considering the state’s appeal of a federal court ruling that would significantly restrict the state’s fundamental authority to allocate surface water.
This primer will analyze the states authority concerning Texans’ water rights and what the outcomes of the pending case means for the Lone Star State.
