The quote in the title of the panel is from a U.S. Supreme Court case dealing with the Endangered Species Act, TVA v. Hill, holding that species should be protected “at any cost.” The case has led to dire consequences for both business and non-business landowners alike under the ESA, but it could apply equally to the history of the implementation history of Clean Air Act and the Clean Water Act.
